They forgot to read and see that he's a former prosecutor (and, in my limited experience with him, a very good jurist).

She seems incompetent, in Trump's pocket or both. Being in his pocket does not imply corruption. She may just be another starry eyed MAGA acolyte, stupid. It doesn't bode well. 

Unfortunately, she can only be removed by senate conviction. Never happen.


I suspect that she is a total MAGAt and saw this as a stepping stone to the Circuit should he or one of his acolytes become POTUS.

Maybe they're getting sick of his whiny appeals. The SC exists to resolve critical constitutional issues. They take only about 80 cases a year. They're not there to spend their whole year dealing with Trump's issues.


The DOJ is petitioning the court to get rid of the special master, basically claiming that Judge Cannon's opinion on the matter is full of crap.

Appeals Court Scraps Special Master Review in Trump Documents Case (NYT)

WASHINGTON — A federal appeals court on Thursday removed a major obstacle to the criminal investigation into former President Donald J. Trump’s hoarding of government documents, ending an outside review of thousands of records the F.B.I. seized from his home and freeing the Justice Department to use them in its inquiry.

In a unanimous but unsigned 21-page ruling, a three-member panel of the U.S. Court of Appeals for the 11th Circuit in Atlanta shut down a lawsuit brought by Mr. Trump that has, for nearly three months, slowed the inquiry into whether he illegally kept national security records at his Mar-a-Lago residence and obstructed the government’s efforts to retrieve them.

The appeals court was sharply critical of the decision in September by Judge Aileen M. Cannon, a Trump appointee who sits in the Southern District of Florida, to intervene in the case. The court said Judge Cannon never had legitimate jurisdiction to order the review or bar investigators from using the files, and that there was no justification for treating Mr. Trump differently from any other target of a search warrant.

If only there was Federal Traffic Court so Judge Cannon could be shunted there.

So, it was not technically moot, but yesterday was the day final submissions were to be made to the Special Master.  Glad that they ruled as quickly and strongly as they did.

Screw the Republicans. McConnell likes to play games? I suggest Democrats do one better.

If a Republican gets into the WH and the senate is controlled by Democrats then don't pass any nominations recommended by or who belong or have any past association with the Federalist society.

I don't care if there are 2, 3, 4,  or 5 SC vacancies or other vacancies. If the Federal Judiciary gets bogged down by vacancies, then so be it. Its better than getting stuck with lifetime toxic jurists from that society.

I feel like this will be one of those things on whatever the future version of Unsolved Mysteries will be. Like 30 years in the future, that era's Robert Stack will be talking about a box of highly classified documents that was never recovered, rumored to be in a safe in the underwater ruins off of New Miami...


It’s actually worrisome to think what would be the purpose of him hiding these documents. I’m thinking they would fetch a pretty penny if he could sell them to lil Kim, Xi Xi, or Rasputin. Maybe he saw this as a form of income if he lost his businesses. It’s just a crazy situation.

Prosecutors have urged a federal judge to hold Donald Trump’s office in contempt of court for failing to fully comply with a May subpoena to return all classified documents in his possession, according to people familiar with the matter — a sign of how contentious the private talks have become over whether the former president still holds any secret papers.

In recent days, Justice Department lawyers have asked U.S. District Judge Beryl A. Howell to hold Trump’s office in contempt, according to the people, who spoke on the condition of anonymity to describe sealed court proceedings. But the judge has not yet held a hearing or ruled on the request, they said.

The request came after months of mounting frustration from the Justice Department with Trump’s team — frustration that spiked in June after the former president’s lawyers provided assurances that a diligent search had been conducted for classified documents at his Mar-a-Lago Club and residence. But the FBI amassed evidence suggesting — and later confirmed through a court-authorized search — that many more remained.

One of the key areas of disagreement centers on the Trump legal team’s repeated refusal to designate a custodian of records to sign a document attesting that all classified materials have been returned to the federal government, according to two of these people. The Justice Department has repeatedly sought an unequivocal sworn written assurance from Trump’s team that all such documents have been returned, and Trump’s team has been unwilling to designate a custodian of records to sign such a statement while also giving assurances that they have handed documents back.

Sounds like Trump wants his lawyers to potentially lie for him, and they don't want to do it.


Judge Cannon has officially dismissed the lawsuit from Team 45 that resulted in the Special Master appointment. She cites lack of jurisdiction. This should have been the case all along, but now the FBI has full access to all the materials seized from the Mar-A-Lago warrant search. 

It’s a typical tactic for Trump to pursue any legal maneuver to delay court proceedings. The current special counsel, Jack Smith, has a reputation for being a no-nonsense bulldog and it will be interesting to see how the usual Trump BS plays out. Now that the midterms are done I think things will start really falling into place. 

It’s a pretty cut and dried situation. Trump took government documents inappropriately. He was asked to return them more than once. Including a court subpoena about 15 months after he left office. He and his staff still failed to comply and the FBI executed a duly issued search warrant which revealed dozens of government documents on the premises. 

The question of classified or not is immaterial. He had government property in his possession. His behavior indicates this was not an accident. He had multiple opportunities to rectify the situation. 

This dismissal means that investigation can move forward in impeded (for now). What it also opens up is the possibility of finding evidence of other criminal activity in the materials that were seized, since the DOJ has access to all of it.

Federal prosecutors overseeing the investigation into former President Donald J. Trump’s handling of classified documents are seeking to pierce assertions of attorney-client privilege and compel one of his lawyers to answer more questions before a grand jury, according to two people familiar with the matter, adding an aggressive new dimension to the inquiry and underscoring the legal peril facing Mr. Trump.

The prosecutors have sought approval from a federal judge to invoke what is known as the crime-fraud exception, which allows them to work around attorney-client privilege when they have reason to believe that legal advice or legal services have been used in furthering a crime. The fact that prosecutors invoked the exception in a sealed motion to compel the testimony of the lawyer, M. Evan Corcoran, suggests that they believe Mr. Trump or his allies might have used Mr. Corcoran’s services in that way.
