A QUESTION FOR BOTH THE HOUSE MANAGERS AND THE PRESIDENT'S LAWYERS

And anyone else who wants to answer

The Constitution lists "Treason" as a ground for impeaching and removing a President.

It defines "Treason" as consisting "only in levying War against them (The United States), or in adhering to their Enemies, giving them Aid and Comfort".

The President determines foreign policy. Therefore, is it not impossible for the President to commit Treason?

If I was a juror, that would have been a convincing argument.

It seems that someone raised it quite awhile ago. Could have been around the time of the Mueller report, but I remember hearing that phrase, "aid and comfort to the enemy" in reference to Trump.

On the charge of obstruction, I was annoyed at the lawyer's blanket argument that the subpoenas were all denied for legitimate reasons.

Its going to be painful watching the State of the Union address.

At the time the Constitution was written, there was also the now-quaint custom where Congress declared war, deciding who was the "enemy" making war.  So it wasn't just the President's call.

There are no longer Declarations of War. So not sure Treason is still a thing

WHY IS THE THREAD TITLE YELLING AT ME?

if one is to believe the Trump defense, as long as a president claims to believe he/she is acting in the best interests of the country (no matter how much that claim may strain credulity), he/she should NOT be impeached for any act committed. If the Trump impeachment actually becomes precedent, impeachment of the POTUS has itself been rendered moot.

Probably hit Caps Lock. If it bothers you that much I'll change it

Caps never bothered me. It does tend to focus attention.

But who started the silly convention that caps is yelling?

The truth is that no precedent can actually be set with respect to Impeachment because a future House of Reps can do whatever it wants by majority vote and a future Senate can convict with a 2/3 vote or not convict for any reason.
